Terms of Service

1. Acceptance of these terms

These Terms of Service (the "Terms") form a binding agreement between you and Codedreams LLC, a Wyoming Limited Liability Company ("Codedreams", "we", "us", or "our"), governing your access to and use of https://codedreams.site (the "Site") and any mobile application that we publish under the Codedreams name (each, an "App"; together with the Site, the "Services").

By accessing or using the Services, you confirm that you have read, understood and agree to these Terms. If you do not agree, do not access or use the Services.

2. Eligibility

You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use the Services. If you are under the age of legal majority in your jurisdiction, you may use the Services only with the involvement of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

3. License to use the Services

Subject to your continuing compliance with these Terms, Codedreams grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to access and use the Services for your personal, non-commercial use.

This license does not include any right to: (a) resell, redistribute or commercially exploit any part of the Services; (b) reverse engineer, decompile or disassemble any portion of the Apps except to the extent that applicable law expressly permits; or (c) use the Services in a way that infringes the rights of others or violates applicable law.

4. Acceptable use

When using the Services, you agree not to:

• Use the Services in any unlawful manner or for any unlawful purpose;
• Attempt to gain unauthorised access to any part of the Services, other accounts, or systems or networks connected to the Services;
• Interfere with or disrupt the Services or the servers or networks that host them;
• Upload, transmit or distribute any viruses, malware or other harmful code;
• Use any automated means (bots, scrapers, crawlers) to access the Services in a way that sends more requests than a human can reasonably produce;
• Submit content that is unlawful, defamatory, harassing, infringing or otherwise objectionable.

5. Purchases and subscriptions

Where an App offers paid features, in-app purchases or subscriptions, those transactions are processed by the relevant app store (Apple App Store or Google Play). Pricing, billing, renewal and cancellation are governed by the terms of that store and the disclosures shown to you at the time of purchase. Codedreams is not the merchant of record for these transactions.

If a paid feature does not work as described, please contact us first at appsupport@codedreams.site and we will work with you to resolve the issue.

6. Intellectual property

The Services, including all software, text, graphics, logos and other content, are owned by Codedreams or its licensors and are protected by United States and international intellectual property laws. Except for the limited license granted in Section 3, these Terms do not transfer any right, title or interest in the Services to you.

7. Your content

If an App permits you to submit content, you retain ownership of that content. You grant Codedreams a worldwide, royalty-free, non-exclusive license to host, store and display your content as necessary to operate the Service, and to make the back-end and synchronisation features of the App work as intended. You are solely responsible for the content you submit and warrant that you have all necessary rights to do so.

8. Third-party services

The Services may contain links to or integrate with third-party websites, services or content. Codedreams is not responsible for and does not endorse any third-party services. Your use of any third-party service is governed solely by the terms and policies of that third party.

9. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement or uninterrupted or error-free operation. Codedreams does not warrant that the Services will meet your requirements or that defects will be corrected.

10. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Codedreams, its officers, members, employees or agents be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenues, data or goodwill, arising out of or in connection with your use of the Services. Codedreams' total cumulative liability for any claim arising out of or relating to the Services shall not exceed the greater of (a) the amount you paid Codedreams in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred United States dollars (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent that any such exclusion or limitation is not permitted, the foregoing limitations apply only to the maximum extent permitted by applicable law.

11. Indemnification

You agree to defend, indemnify and hold harmless Codedreams and its officers, members, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your violation of these Terms; or (c) your violation of any rights of a third party.

12. Termination

You may stop using the Services at any time. Codedreams may suspend or terminate your access to the Services, with or without notice, if we believe that you have breached these Terms or that your use poses a risk to other users, third parties or Codedreams. Sections that by their nature should survive termination (including Sections 6, 9, 10, 11 and 13) will survive.

13. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles. To the extent permitted by applicable law, any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Wyoming, and you and Codedreams consent to the personal jurisdiction of those courts. Nothing in this Section limits any mandatory consumer protection rights you may have in your country of residence.

14. Changes to these Terms

We may modify these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Material changes will be communicated through the Services or by other reasonable means. Your continued use of the Services after the changes take effect constitutes acceptance of the updated Terms.

15. General

• Entire agreement. These Terms, together with our Privacy Policy and any additional terms presented within an App, constitute the entire agreement between you and Codedreams regarding the Services.
• Severability. If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
• No waiver. Codedreams' failure to enforce any provision of these Terms is not a waiver of its right to do so later.
• Assignment. You may not assign these Terms without our prior written consent. Codedreams may freely assign these Terms.
